A Study Finds That 88 Percent of Clinics in London Violate Regulations Regarding Botox Advertising

It is against the law in the UK to advertise drugs that can be obtained with prescription-only medications, such as Botox.

According to findings from a study carried out by a university in London, the majority of beauty clinics in London violate the law in the United Kingdom by advertising Botox. 

As is the case with all medications that are available as prescription-only drugs, advertising botulinum toxin in the United Kingdom is against the law due to the Human Medicines Regulations 2012 law. 

All unethical advertisements are banned, including those for Botox, Vistabel, Dysport, Bocouture, and Azzalure, as well as the term “anti-wrinkle injections.”

Among the 233 independent clinics randomly selected for the study, 206 did not follow the guidelines for advertising prescription medicines as outlined by the Advertising Standards Authority between December 2021 and January 2022. This study was published in the Journal of Cosmetic Dermatology.

142 of the 206 premises (or 61%) were found to be unethically advertising “Botox” or other brand names, while the remaining premises used language such as “anti-wrinkle injections” or other prohibited phrases in their advertisements.

According to the paper’s author, there is concern that commercials for prescription drugs could put consumers at risk, so legislation is being drafted to require the industry to become licensed.

At the beginning of the year 2020, the Advertising Committee in the UK, which collaborates with the Advertising Standards Authority, issued a notice of enforcement to practitioners, reminding them that it is against the law to advertise drugs that are available only as prescription-only medications. 

The notice stated that after Friday, January 31, 2020, targeted enforcement action using monitoring technology would be carried out in locations where problematic posts were discovered online.   

The government of the United Kingdom has been under increasing amounts of pressure over the past few months to implement the promised licensing regime for non-surgical cosmetic procedures in order to prevent a “wild west” situation from developing. 

In August of last year, the chairman of one of the United Kingdom’s Health and Social Care Committees said that the government must act immediately to end the current situation in which anyone can perform non-surgical cosmetic procedures, regardless of training or qualifications.

In the meantime, industry associations are working to make it easier for customers to find reputable beauty services and practitioners. 

The British Association of Beauty Therapy and Cosmetology (BABTAC) has launched a campaign this year called T.I.M.E. that aims to teach customers what questions they should be asking before scheduling beauty treatments to avoid being scammed.
